Quando a Inglaterra resolveu cobrar impostos dos colonizadores, muitos se recusaram a comprar os produtos tributados dando início a uma grande revolta contra a Inglaterra. Um ato contra a cobrança de impostos, de grande importância em 1773 foi "Boston Tea Party", em Boston - Massachussetts, onde colonizadores, disfarçados de indíos, destruiram mais de 3 centenas de caixas de chá retirando-as dos navios ingleses e jogadando-as ao mar. Várias leis intoleráveis impostas pela Coroa Inglesa, provocaram a convocação do primeiro Congresso Continental de Filadélfia, em 1774, pedindo ao Rei e ao Parlamento a revogação da legislação autoritária e igualdade de direitos aos colonizadores.

Escrita por uma comissão de 5 membros e liderada por Thomas Jefferson, foi promulgada em 4 de julho de 1776 na Filadélfia por delegados de todos os territórios.
